Promotion Policy / Media Release
Policy on Promotion/Graduation:
Students will be awarded belt advancements at periodic intervals based on their accomplishment of required curriculum and their attendance of classes. To cover the cost of such things as instructors’ additional time in preparing each student prior to advancement, the belt and certificate, promotion day and graduation ceremony expenses, there will be a minimal fee for testing that is not included in monthly tuition cost ($49 at the beginner ranks).
Permission to use Media:
I grant to American Martial Arts Academy, AMAA-2 & Martial Arts Business Coaching, LLC, the right to take photographs, videos, and audio of me and my family in connection with training at AMAA-2. I authorize American Martial Arts Academy, AMAA-2 & Martial Arts Business Coaching, LLC, its assigns and transferees to copyright, use and publish the same in print and/or electronically.
I agree that American Martial Arts Academy, AMAA-2 & Martial Arts Business Coaching, LLC may use such photographs & videos of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.
I understand that there will be no financial or other remuneration for recording me, either for initial or subsequent transmission or playback and that American Martial Arts Academy, AMAA-2 & Martial Arts Business Coaching, LLC has no control over other students taking photographs of themselves or their family member(s) in or around the studio.
HOLD HARMLESS / WAIVER / RELEASE AGREEMENT
I understand that the training, instruction, and/or lessons which I have registered for and will receive at American Martial Arts Academy & AMAA-2 involves strenuous physical activity and physical contact with the instructors and students of American Martial Arts Academy & AMAA-2. These activities may be hazardous and may result in personal injury. The person and guardian (if applicable) whose signature appears below states that he or she has no knowledge of any physical condition that would render these activities dangerous and/or hazardous to his or her health, or the health of his or her ward (if applicable). I promise to notify American Martial Arts Academy & AMAA-2 instructors immediately, in writing and delivered in person to an instructor of American Martial Arts Academy & AMAA-2, before the next lesson to be received, if any such condition should develop. After review of the written notification, American Martial Arts Academy & AMAA-2 reserves the right to terminate instruction if the review warrants such action.
Additionally, American Martial Arts Academy & AMAA-2 urges all members to obtain a physical examination from his or her physician prior to the attendance of any exercise program, or use of any equipment at the American Martial Arts Academy & AMAA-2.
The enrolled member recognizes that they are enrolling in a martial arts facility and that American Martial Arts Academy & AMAA-2 will provide a place of instruction for all classes and practice sessions as well as qualified instructors for these classes. We take reasonable care to prevent accidents and to minimize injuries. We require that the students obey the rules and regulations of the school. No member shall practice free sparring or self-defense techniques without a qualified instructor present.
In recognition, the person and guardian (if applicable) whose signature appears below, with full personal knowledge, voluntarily waives any right or cause of action of any kind, both individually and for their heirs, executors, administrators and successors, arising as a result of taking martial arts lessons at American Martial Arts Academy & AMAA-2, and from any competitions that they may enter as a student of American Martial Arts Academy & AMAA-2, which any liability may or could be assigned to American Martial Arts Academy & AMAA-2, its instructors, employees, officers and administrators.
STUDENT / FITNESS INSTRUCTOR ARBITRATION AGREEMENT
Article 1. It is understood that any dispute of liability of any service rendered under this agreement, whether unnecessary or unauthorized or improperly, negligently, or incompetently rendered, will be determined by submission to arbitration as provided by California law, and not by a lawsuit or resort to court process except as California law provides for judicial review of arbitration proceedings. Both parties to this agreement, by entering into it, are giving up their constitutional right to have such disputes decided before a court of law before a jury and instead are accepting the use of arbitration. It is further agreed that all rights to full and complete disclosure are available to all parties through arbitration.
Article 2. I understand and agree that this arbitration agreement binds me and anyone else who may have a claim arising out of or related to health/fitness instruction at American Martial Arts Academy & AMAA-2. This includes, but is not limited to, all claims for monetary damages exceeding the jurisdictional limits of the small claims court, including, without limitation, suits of loss of consortium, wrongful death, emotional distress or punitive damages. I further understand and agree that by signing this agreement on behalf of some other person for whom I have responsibility, then, in addition to myself, such other person(s) will be bound, along with anyone else who may have a claim arising out of the services rendered to that person. I understand and agree that this agreement relates to claims against the health/fitness instructor and any employees, agents, and estates of any of them. I also hereby consent to the intervention or joinder in the arbitration proceeding of all parties relevant to a full and complete settlement of any dispute arbitrated under this agreement, as set forth in the California arbitration rules.
Article 3. I understand that I do have to sign this agreement to receive health/fitness instruction by any American Martial Arts Academy & AMAA-2 instructor, and that if I do sign this agreement and change my mind within thirty (30) days of today’s date, then I may cancel this agreement by giving written notice to the undersigned instructor within that time stating that I want to withdraw from this arbitration agreement. Such withdrawal also rescinds any agreement for American Martial Arts Academy & AMAA-2 to provide instructional services.
Article 4. On behalf of myself and all others bound by this agreement as set forth in Article 2, agreement is hereby given to be bound by the arbitration rules of the state of California, as it may be amended from time to time, which are hereby incorporated into this agreement. I understand that disputes covered by this agreement will be covered by California law applicable to action against health/fitness instructors.
NOTICE: BY SIGNING THIS AGREEMENT YOU ARE AGREEING TO HAVE ANY ISSUE OF LIABILITY DECIDED BY NEUTRAL ARBITRATION AND YOU ARE GIVING UP YOUR RIGHT TO A JURY OR COURT TRIAL. SEE ARTICLE 1 OF THIS CONTRACT.
Health Fitness Instructor’s Agreement to Arbitrate: In consideration of the foregoing execution of this student-instructor arbitration agreement, I likewise agree to be bound by the terms set forth in this agreement and in the rules specified in Article 4 above.
COVID-19
ACKNOWLEDGMENT AND DISCLOSURE
I understand that during this COVID-19 Public Health Emergency, American Martial Arts Academy (AMAA) strongly recommends that ONLY STUDENTS enter the facility beyond the designated drop-off & pick-up area. I understand that this procedure change is for the safety of all persons present in the facility and to limit to the extent possible everyone’s risk of exposure.
Students should come dressed in uniform. Please bring no extra items besides a water bottle.
I understand that I MUST sanitize my hands before entering the AMAA facility, and wear a protective face mask or covering. While in the facility I must practice physical distancing and remain 6 feet from all other people (and have no physical contact with individuals), except for my own family/household members.
I understand that to enter the AMAA premises my child and myself and all other members living in the same household must be free from COVID-19 symptoms. If, during their stay at AMAA, any of the following symptoms appear, my child will be separated from the rest of the people in the studio. I will be contacted, and my child MUST be picked up from AMAA within 15 minutes.
Symptoms include:
Fever of 100 degrees Fahrenheit or higher
Dry cough
Shortness of breath
Chills
Loss of taste or smell
Sore throat
Muscle aches
While many of these symptoms might be non-COVID-19 symptoms we are proceeding by assuming they are Covid-19 during this Public Health Emergency. These symptoms typically appear 2-7 days after being infected so please take them seriously. Your child / you / your household members will need to be symptom free for 72 hours before returning to the AMAA facility.
I understand that my child and whoever brings the child into the AMAA facility must always wear a protective face mask or covering while in the facility and on AMAA premises.
I understand that students will be required to use hand sanitizer and/or hand washing according to CDC recommended hand cleaning procedures.
I understand that AMAA encourages all students & families to comply with recommended health precautions as outlined by the CDC and government authorities.
I will immediately notify AMAA management if I become aware of any person with whom my child or I have had contact, exhibits any of the symptoms listed in Number 4 above, is advised to self-isolate, quarantine, or has tested positive, or is presumed positive for COVID-19. Further, I will immediately notify AMAA management if anyone from my place of employment is presumed positive or tests positive for COVID-19 whether or not I have had direct contact with that person.
I understand that all persons entering AMAA premises will be in contact with children, families and employees who are also at risk of community exposure. I understand that no list of restrictions, guidelines or practices will remove 100% of the risk of exposure to COVID-19 as the virus can be transmitted by persons who are asymptomatic and before some people show signs of infection. I understand that I play a crucial role in keeping everyone in the AMAA facility healthy and reducing the risk of exposure by following the practices outlined herein.
I certify that I have read, understand, and agree to comply with the provisions listed herein. I acknowledge that failure to act in accordance with the provisions listed herein, or with any other policy or procedure outlined by AMAA will result in swift action up to and including termination of all AMAA-related services being received.
